SUMMARY
- This week, the European Commission published in the Official Journal of the European Union the final legal text of the Delegated Regulation on the derogations from the ban on the destruction of unsold products under the ESPR.
- Members can find the legal text attached as well as on this page.
- The content of the legal text remains unchanged since its publication by the Commission in the beginning of February. In consequence, FESI’s analysis from February remains up to date (available in the attachment).
- As a reminder, Article 25(1) of the ESPR prohibits the destruction of certain unsold consumer products by large economic operators from the 19th of July 2026 and for medium enterprises as of 19th of July 2030. The prohibition does not apply to micro and small enterprises.
