
FESI analysis of the draft secondary legislation on reporting requirements and derogations under the ESPR
SUMMARY
- Based on available documents, FESI analysed and summarised the draft implementing act on the reporting format and the draft delegated act on the derogations from the destruction of unsold consumer products under the ESPR. Members can find FESI summaries attached.
- Both legislative documents are still in draft format and pending publication. Once they are adopted, FESI will update the analysis and circulate a new version.

Implementing Act on the reporting format (The EC draft text & Annexes)
The draft implementing act clarifies the type, and format of required information and it also includes a section dedicated to the verification (Annex III). There are no changes as regards to product categories or timelines for disclosure since the previous draft shared with members.
Delegated Act on the derogations from the ban on the destruction (The EC draft text)
The draft delegated act covers the list of derogations (11 in total) and linked to them required documentation for verification. Additionally, the draft specifies the interlink with the Waste Framework Directive.

The IA is pending now the publication in the Official Journal to the European Union.
Delegated Act on the derogations from the ban on the destruction :
The DA is pending now adoption by the College of Commissioners, followed by EP and the Council standard scrutiny period of 4 months, with a final step – publication in the OJEU.
