Commission extends CBAM scope to more aluminium/steel downstream products and publishes legal acts for definite period

The Commission has adopted CBAM Implementing/Delegated Acts for the definite period starting from January 2026 and extended the scope to some steel and aluminium downstream products from 2028. The press release is available here. The list of adopted acts is available here.

Extension to downstream products: Starting January 1, 2028, CBAM's scope will expand to include specific steel and aluminium-intensive downstream products. The full Annex of added products available here. In September, FESI had submitted its feedback to the consultations on the potential expansion to downstream products (more details in the email below).

Temporary Decarbonisation Fund: The European Commission has launched a fund to temporarily support EU producers of CBAM goods (annex with eligible goods here) and mitigate carbon leakage risks.

CBAM review report: Commission findings highlight CBAM as a key driver in the promotion of decarbonisation in countries outside of the EU.

NEXT STEPS

The CBAM definitive period will start on 1 January 2026.

The extension to some steel and aluminium downstream products will apply from 1 January 2028. The Commission urges importers of CBAM goods (or their indirect customs representatives) to apply for the status of authorised CBAM declarants if they have not done so yet.
