
Council adopts position on chemical products simplification (Omnibus VI)
On 5th November EU Council reached political agreement on its mandate for the remaining part of the Omnibus VI package.
This is the package that simplifies rules for chemical products (could apply for example to DWR agents/sprays sold to end consumers or B2B Chemical products) – classification, packaging, labelling, cosmetics and fertilising products, “while still keeping high consumer / environment protection”.
This is strategically tied to the competitiveness and “simplification revolution” direction set by the European Commission following the Letta and Draghi reports.
- Key elements of the Council’s position include a “digital by default” approach to simplify labelling and communication, eliminating duplicate requirements, and clarifying timelines. The text strengthens consumer protection regarding nanomaterials and hazardous substances in cosmetics and introduces new registration obligations for micro-organisms in fertilisers.
- For the CLP regulation, the Council aligned definitions with ongoing digitalisation efforts, reintroduced a telephone contact requirement alongside digital options, and simplified readability standards for labels. It also reduces information requirements for professional advertisements and clarified exemptions for business-to-business online sales.
- The Council presidency can now begin negotiations with the European Parliament to reach a final agreement on the legislation.
