
EU Updates PFAS Restriction Proposal
On 20 August the European Chemicals Agency (ECHA) published the updated proposal to restrict PFAS under the EU’s REACH regulation.
This update was made with the 5 dossier submitters, following the evaluation of over 5,600 consultation comments and expands the scope of analysis to additional sectors, including technical textiles.
FESI is still processing the thousands of pages very technical documentation and annexes, but notable updates are listed below. Please note that at this stage the text is a draft proposal. We are still expecting the RAC and SEAC draft opinions which will be open for a 60-day consultation, and which will be shared with our members.
· The general transition period remains 18 months after Entry into Force (EiF) for consumer apparel, footwear, outdoor technical textiles (e.g. tents, backpacks, ropes) and after-market sprays.
· No derogations are proposed for consumer apparel/footwear or camping equipment.
· PPE (professional protective equipment) could benefit from derogation up until 12 years provided certification and import proof allow it.
· Textiles with recycled content also could benefit from derogation up until 12 years, provided traceability and proof of recycled content are ensured.
· Second-hand, repair and resale remain unaffected (non-retroactivity confirmed).
ECHA’s committees for Risk Assessment (RAC) and Socio-Economic Analysis (SEAC) are now reviewing the draft and finalizing their draft opinions. The European Commission will decide on the final restriction in consultation with Member States.
