Parliament amendments to the Omnibus

The Parliament's JURI Committee political parties and many individual MEPs have submitted amendments to the Omnibus.

Amendments proposals submitted by MEPs and political groups touch any sides of the spectrum, including calls to repeal the Omnibus as a whole and cancelling certain reporting requirements altogether.

FESI updated its document on Omnibus positions with a summary of the most relevant amendments from the four main political groups with an agreement to cooperate and find a compromise: EPP, Renew, S&D, Greens (attached, from page 7). These amendments were submitted in addition to the Parliament Rapporteur Draft Report previously shared with you in June (also attached, from page 2).

  • CSRD Assurance: Generally, everyone is calling for the development of guidelines; The EPP is pushing for standards to be adopted as well; S&D and greens would like to retain reasonable assurance; RENEW proposes phased-in approach for medium size companies.
  • CSDDD risk-based vs Tier 1: EPP generally agrees with limiting to Tier 1; S&D and Greens are pushing for risk-based; RENEW proposes a mixed approach (risk-based but with limited liability).
  • ESRS: General agreement on following current EFRAG reviewing approach; Renew is calling for sector- specific guidelines; S&D would like to retain the development of sector specific standards.
  • Requests to SMEs: EPP proposes allowing the reporting on the efforts taken to access information when not possible; they also propose allowing SMEs to decline access to information (in line with FESI request); other groups would allow SME shield but with a company cap (500 and 250 employees).

NEXT STEPS

As the Parliament enters the summer recess, these amendments will likely be better discussed starting from the end of August to find a compromise for a Parliament position, which may take a while to reach given the level of diverging positions. FESI will keep engaging with stakeholders to help them reach a negotiating position that better aligns with our asks, many of which are currently generally reflected in the EPP amendments.
